Apple and Microsoft file patents for touchless controls
interesting stuff. .. i do think its only a matter of time until apple tv gets a video games update.

Pretty sure this sort of thing has already been made by people on the pc. Not for anything useful that is but the style of control is already there. So how can you have it patented?

Patent Offices don't care who actually came up with the technology first, but who filed their paperwork and paid their fees first. Plus, in your example you only mention gestures. These companies are aiming to patent gestures tied to an act. But the more nebulous you can make your patent, the better. It allows your lawyer to be more aggressive in perusing your rightful licences from others.
