He requested a reduced sentence, saying the crime was less serious because the girl had already had several sexual partners.

His request was rejected, but Italy's high court said the judges should re-evaluate the decision because the girl "since the age of 13 had had many sexual relations with men of every age."

"And it's right to assume," the ruling went on, according to ANSA, "that at the time of the encounter with the suspect her personality, from a sexual point of view, was much more developed than what one might normally expect from a girl of her age."

The suspect's lawyer, Andrea Biccheddu, defended the ruling, saying the episode between his client and the girl "didn't provoke any trauma," because the girl had had so many sexual partners.

He said his client deserved to have his sentence reduced by two thirds, the agency said.

thats 2 different things of wanting to have sex and then not wanting to have it and forcing it on someone.

by what he says, he could rape older married women who have like 9 kids cause she is sexually active it makes it ok....

If someone gave me a dollar for every sexually active 13 year old...

...My bank account would make Bill Gates account look like a midget. IMO In 100 years the new legal age will be 12-13.

The legal age here is 16, some people are trying to lower it to 14-15. In Denmark it is 15.

Don't think for a second I'm supporting him - but do they class it as rape even if she did want it, just as she's underage and therefore "doesn't know what she wants" or something? Otherwise, I don't understand why he'd have said "but she was sexually active" expecting that made everything ok.

A friend of mine was raped regularly at 12 and then again at 14 - and it messed her up with relationships with guys - sounding very similar to the description of the young girl in this case.

I also think 3 years for child rape is pretty out of order ~ a reduced sentance on that was just be taking the mickey

I remember back in middle school when I was twelve or so there were tons of skanks running around having sex and getting pregnant. Some were even younger. I lived in a nice area too. Then they got hooked on drugs, of course, being so rich. Pretty sad, really. They got what they deserved though. VDs and foster parents.
